General Business Terms and Conditions (21.11.2005)
When you place an order or also if you participate in a prize draw or a survey you acknowledge the following General Business Terms and Conditions of orsay.com and Orsay GmbH.
1. Delivery Orders
which are received at orsay.com are sent within the given delivery times (see overview of countries). In exceptional cases there may be delays in deliveries or part deliveries. In these cases you will be informed by e-mail. In case of a part delivery orsay.com will assume the additional despatch costs.
2. Delivery periods and despatch costs per country
We deliver free of despatch charges from an order value of € 49.-. Please see the following table for the delivery period. Please also refer to the following table for the despatch costs for orders with an order value of less than € 49.- .

3. Payment
All prices stated at orsay.com include the applicable rate of value added tax. All offered modes of payment are absolutely safe. You can pay as follows at orsay.com:
(A) Payment per credit card: An order per credit card is especially protected by an SSL encoding of the data. In case of improper use of a credit card the majority of banks assume either all the costs incurred through the improper use or limit the liability of their customers to a max. of EUR 50. This own share will be assumed by orsay.com up to this amount if the improper use of your credit card data is a result of a purchase at orsay.com and was not caused through an error on your part. orsay.com accepts Visa, Visa Electron, EuroCard/MasterCard and American Express.
(B) Payment by cash on delivery (at present only with delivery to Germany):You pay the postman when your delivery is handed over. Collection charges are due in addition to the despatch costs. Please refer to the table above for the actual value.Attention: In addition, a transmission fee for the Postbank of € 2.-. is to be paid directly to the postman.
(C) Payment by bank transfer (currently possible from a German or Austrian account):Please transfer the total amount of your order onto the account stated in the order confirmation.

As soon as the payment is received at orsay.com, the order will be released and despatched. The delivery period is thus extended by this period of time. orsay.com shall wait a max. 5 workdays for the receipt of the payment, subsequently the order will be cancelled automatically. If an amount is received too late onto the Orsay account, it will be transferred back within approx. 15 workdays.
4. Orders
As a matter of principle, the order is placed by you as customer and will become effective when received at orsay.com. Orsay.com reserves the right not to accept orders, e.g. if articles are sold out. If orsay.com cannot execute an order, orsay.com shall inform you of this as quickly as possible per e-mail. After receipt of your order, orsay.com will send you an order confirmation per e-mail if you have given your e-mail address when placing the order.
As soon as your delivery leaves the warehouse, you will be informed by e-mail again. In case an order cannot be served and is returned to us, it is unfortunately not possible to despatch the parcel again. In this case you must place the order again. Should you have already paid for the goods which were not served, you will be refunded the money incl. despatch costs automatically within approx. 28 workdays after receipt of the return consignment in our warehouse.
5. Articles which are sold out
Unfortunately articles are sometimes sold out. If you have already paid for the goods which are sold out per credit card or bank transfer in advance, the money will be refunded onto your credit card or your account within approx. 15 workdays.
6. Right of return
At orsay.com you have a guaranteed right of return.You can return goods which have not been damaged or worn within 14 days after receipt.
The goods can be returned to all ORSAY branches by submitting the enclosed return note. You can then choose another article or be refunded the value of the goods in cash.Alternatively you can send all articles with the return note as carriage forward parcel by post to orsay.com.
Attention: Returns from overseas must be postage paid. Otherwise they can not be served!

The value of the goods (without despatch costs) will be refunded within approx. 15 workdays after receipt of the return consignment in our warehouse. Depending on the chosen mode of payment, the refund will be made onto your credit card or your account or we shall issue you a crossed cheque. Upon request you will also receive an Internet credit note for a new order at orsay.com. Please enter this on the return note.Unfortunately it is not possible to exchange for new/other goods by despatch.
7. Data protection
As a matter of principle, all personal data are treated confidentially. The personal data collected from you are processed and used, in particular stored for the purpose of processing and executing your order. If applicable, your data will also be transmitted to necessary service partners (e.g. transport service) and only processed and used by these for the purpose of order processing. In particular, your data are forwarded to other service companies which orsay.com has commissioned with providing the corresponding services for verification of the address and creditworthiness. When processing the data your concerns which require protection are taken into account according to the statutory provisions. In addition, orsay.com also uses your data for internal marketing purposes. You can object to or revoke your consent for the processing or transmission and other use of your data for marketing purposes at all times by notification per e-mail ((link to the contact form)) to orsay.com. After receipt of your objection or revocation we shall no longer use and process the data concerned for internal marketing purposes.
Your data will not be forwarded to third parties for marketing purposes.

8. Disclaimer for external links
orsay.com has no influence whatsoever on linked sites and therefore assumes no liability for links to which orsay.com refers directly or indirectly.
German law shall apply under the exclusion of the UN law on purchases. Place of jurisdiction is Offenburg.
